_module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>Work health safety legislation<\/h2>\n<p>In South Australian workplaces the legal roles and responsibilities of employers and workers are outlined in the:<\/p>\n<ul>\n<li>Work Health Safety Act 2012 (SA)<\/li>\n<li>Work Health Safety Regulations 2012 (SA)<\/li>\n<li>approved Codes of Practice<\/li>\n<li>Australian Standards.<\/li>\n<\/ul>\n<p>PEER Construction recognises our responsibility to comply with all relevant acts and regulations to ensure that the workplace is safe and to minimise risk to health.<\/p>\n<p><span style=\"font-size: 14px;\">Managers, supervisors and workers shall:<\/span><\/p>\n<ul>\n<li>consider WHS in the workplace design and work methods<\/li>\n<li>comply with all relevant WHS legislation, standards and codes of practice<\/li>\n<li>take responsibility for protecting themselves, their colleagues and visitors<\/li>\n<li>provide adequate resources to meet WHS goals and targets<\/li>\n<li>undertake WHS training and support approved by WorkCover SA<\/li>\n<li>use safe work methods and practice; identify, assess, monitor and control hazards<\/li>\n<li>report and record incidents, accidents, injuries and illness<\/li>\n<li>implement and regularly review and update this WHS policy as required.<\/li>\n<\/ul>\n<p>Contractors, apprentices, and subcontractors who are working on behalf of PEER Construction must comply with the company\u2019s WHS policies, procedures and programs and observe health and safety directions from designated workers.<\/p>\n<p>Failure to comply or observe a direction will be considered a breach of contract and sufficient grounds for termination of the contract.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><strong>At PEER Construction we believe in &#8216;No injuries to anyone at any time&#8217;<\/strong><\/p>\n<p>No process is so important that we cannot find a safe and healthy way of conducting our work.<\/p>\n<p>PEER Construction is committed to the protection of human health, protection of our ecosystem and prevention of pollution.<\/p>\n<p>Our environment, health and safety programs are designed to provide a safe workplace, prevent incidents, minimise environmental impacts and pollution and assure compliance with applicable regulations.<\/p>\n<p>We strive to identify and eliminate negative environmental impacts associated with our activities, services and through the products we supply. This is accomplished through customer service, utilising innovative solutions and best practices, continuous improvement and commitment.<\/p>\n<p>To fulfil this commitment PEER Construction shall:<\/p>\n<ul>\n<li>provide workplace policies, standards, procedures, and training to ensure that workers can perform their jobs in a safe, healthy, and environmentally responsible manner<\/li>\n<li>conduct WHS assessments of activities on the site and take the necessary actions to control identified risks and hazards<\/li>\n<li>provide customers, contractors, and general public with information to ensure that our services and materials provided are recycled or dispose of in a safe and environmentally sound manner<\/li>\n<li>promote pollution prevention, including the conservation of energy, water, and raw materials resources, and ensure that all waste is handled and disposed of responsibly through work standards and the installation of innovative solutions such as, water saving devices<\/li>\n<li>advise customers and regulating bodies of reported spillage, seepage, or disposal of pollutant substances<\/li>\n<li>provide management leadership and require workers to share accountability for continuous improvement in health, safety, and environmental performance<\/li>\n<li>review our policies, objectives and targets, addressing all issues promptly<\/li>\n<li>comply with all relevant laws, regulations and company procedures related to safety, worker health, environmental quality, and public health.<\/li>\n<\/ul>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; background_color=&#8221;#F5F5F5&#8243; global_colors_info=&#8221;{}&#8221;][et_pb_row _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;4_4&#8243; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_text admin_label=&#8221;H2 text to accordion grey backgorund&#8221; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>Roles and responsibilities<\/h2>\n<p>The following have specific responsibilities under the WHS Act.<\/p>\n<p>[\/et_pb_text][et_pb_accordion admin_label=&#8221;Accordion grey background&#8221; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_accordion_item title=&#8221;PCBU (employer)&#8221; open=&#8221;on&#8221; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>The PCBU (employer) has a legal duty of care to protect the health and safety of people in the workplace. This includes people who work casually, part-time, full-time, permanently, as volunteers or as outworkers, apprentices, trainees and work experience students, plus members of the public while they are in your workplace.<\/p>\n<p>As a PCBU we will ensure so far as reasonably practicable that we:<\/p>\n<ul>\n<li>provide and maintain a working environment without risks to health and safety<\/li>\n<li>provide and maintain safe systems of work<\/li>\n<li>provide safe plant and structures, such as machinery, electrical equipment and buildings<\/li>\n<li>safely use, handle and store plant, structures and substances<\/li>\n<li>provide information, training, instruction and supervision about hazards, procedures, policies<\/li>\n<li>provide safe and healthy facilities for the welfare of workers<\/li>\n<li>monitor the health and environment of workers<\/li>\n<li>keep records of injury and illness to monitor overall health and safety in the workplace<\/li>\n<li>consult with workers on work health and safety issues.<\/li>\n<\/ul>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;Managers and supervisors&#8221; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; open=&#8221;off&#8221;]<\/p>\n<p>Managers and supervisors represent the PCBU and must ensure they meet legal work health and safety responsibilities.<\/p>\n<p>Keep up to date with work health and safety information and knowledge, understand and manage the hazards of the business, provide adequate resources, maintain records, meet legislative compliance, provide adequate training and supervision.<\/p>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;Workers&#8221; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; open=&#8221;off&#8221;]<\/p>\n<p>Workers must protect their own safety at work by:<\/p>\n<ul>\n<li>not adversely affecting the health or safety of any other person through any act or omission at work<\/li>\n<li>using any equipment provided for health and safety purposes<\/li>\n<li>obeying any reasonable WHS instruction and workplace policy<\/li>\n<li>complying with PEER Construction work health and safety procedures<\/li>\n<li>identifying risk reduction control measures<\/li>\n<li>monitoring compliance with safe work methods (controls)<\/li>\n<li>ensuring that all works are conducted in a safe manner and without risk to worker&#8217;s health and safety<\/li>\n<li>participating in safety meetings (toolbox talks) and safety programs<\/li>\n<li>following Safe Work Method Statements (SWMS) and Job Safety Analysis (JSA)<\/li>\n<li>reporting hazards, injuries or near misses to management immediately and completing a hazard\/incident or near miss report.<\/li>\n<\/ul>\n<p>[\/et_pb_accordion_item][\/et_pb_accordion][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>Is responsible to:<\/p>\n<ul>\n<li>maintain safety records on projects<\/li>\n<li>maintain and control work health safety and rehabilitation documents<\/li>\n<li>review safety reports and inspections documentation and initiating amendments where necessary<\/li>\n<li>monitor compliance with safe work methods (controls)<\/li>\n<li>observe all work health and safety requirements and statutory rules and regulations<\/li>\n<li>manage and maintain all policies and procedures.<\/li>\n<\/ul>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;Site supervisor&#8221; _builder_version=&#8221;4.17.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; open=&#8221;off&#8221;]<\/p>\n<p>Is responsible to:<\/p>\n<ul>\n<li>implement work health and safety procedures<\/li>\n<li>carry out a design review with the principal contractor\u2019s project team to identify risk reduction control measures<\/li>\n<li>participate in the planning and design stages of trade activities<\/li>\n<li>ensure safe equipment and plant is provided and maintained<\/li>\n<li>review safety reports and inspections and rectify where necessary<\/li>\n<li>monitor compliance with safe work methods (controls)<\/li>\n<li>observe all work health and safety requirements and statutory rules and regulations<\/li>\n<li>ensure all works are conducted safely without risk to worker&#8217;s health and safety<\/li>\n<li>provide advice and assistance on work health and safety to all workers<\/li>\n<li>ensure work health and safety and other relevant legislative requirements are met in the workplace<\/li>\n<li>identify work health and safety training programs and allowing workers identified as requiring training to attend the training<\/li>\n<li>action safety reports and carry out workplace inspections<\/li>\n<li>prepare and participate in safety meetings and safety programs<\/li>\n<li>prepare Safe Work Method Statements (SWMS) and Job Safety Analysis (JSA) and ensuring they are consulted on<\/li>\n<li>encourage a high level of safety awareness and ensuring safe work practices<\/li>\n<li>investigate hazard reports and ensuring that corrective actions are undertaken<\/li>\n<li>conduct project inductions, toolbox talks and daily team briefings.<\/li>\n<\/ul>\n<p>[\/et_pb_accordion_item][\/et_pb_accordion][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; _builder_version=&#8221;4.19.1&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h2>Specific requirements<\/h2>\n<p>Work health and safety legislation requires anyone in the workplace to identify the potential hazards of the proposed work, assess the risks involved and develop controls to eliminate, or minimise, the risk.<\/p>\n<p>Ensure the hazard identification and JSA \/ SWMS policy is followed at all times.<\/p>\n<p><strong>WHS Self-Checklist<\/strong><\/p>\n<p>As part of evaluating how we are working within the WHS guidelines, a self-assessment checklist should be completed by staff. This includes people who work for you casually, part-time, full-time, permanently, as volunteers or as outworkers, apprentices, trainees and work experience students, plus members of the public while they are in your workplace.\r\n\r\nA worker has a \u201cduty of care\u201d to follow instructions that a PCBU establishes to protect their health and safety at work. For example \u2013 wear safety glasses provided.\r\n\r\nProduct manufacturers, suppliers, designers, installers, those who commission and building owners also have a \u201cduty of care\u201d towards people in your workplace\r\n\r\nAs a PCBU we will ensure, so far as reasonably practicable that we:\r\n<ul>\r\n \t<li>provide and maintain a working environment without risks to health and safety<\/li>\r\n \t<li>provide and maintain safe systems of work, i.e. safe ways to perform specific tasks<\/li>\r\n \t<li>provide safe plant and structures, such as machinery, electrical equipment and buildings<\/li>\r\n \t<li>safely use, handle and store plant, structures and substances i.e., chemicals stored safely<\/li>\r\n \t<li>provide information, training, instruction and supervision, e.g. about hazards, procedures, policies<\/li>\r\n \t<li>provide safe and healthy facilities for the welfare of workers<\/li>\r\n \t<li>monitor the health and environment of workers<\/li>\r\n \t<li>keep records of injury and illness to monitor overall health and safety in the workplace<\/li>\r\n \t<li>consult with workers on WHS issues<\/li>\r\n<\/ul>\r\n<strong>Officers<\/strong> have responsibility for meeting the due diligence requirements towards health and safety of PEER. This will be done by making sure that things are done such as; keeping up to date with WHS information and knowledge, understanding and managing the hazards of the business, providing adequate resources, maintaining records, meeting legislative compliance, providing adequate training and supervision.\r\n\r\n<strong>Supervisor\/manager<\/strong> are deemed to act as a representative of the PCBU and therefore have WHS responsibilities to ensure that they are meeting those legal responsibilities.\r\n\r\n<strong>Workers<\/strong> have a duty of care under Section 28 of the WHS Act. A worker must:\r\n<ul>\r\n \t<li>Protect their own safety at work<\/li>\r\n \t<li>not adversely affect the health or safety of any other person through any act or omission at work<\/li>\r\n \t<li>use any equipment provided for health and safety purposes, e.g. trolley, fume hood<\/li>\r\n \t<li>obey any reasonable instruction and workplace policy in relation to WHS.<\/li>\r\n<\/ul>\r\nPEER Construction recognises our responsibility to comply with all relevant Acts & Regulations to ensure that the workplace is safe and without risk to health. Managers, Supervisors & employees shall:\r\n<ul>\r\n \t<li>Consider WHS in the workplace design and standard work methods.<\/li>\r\n \t<li>Comply with all relevant WHS legislations, standards & codes of practice.<\/li>\r\n \t<li>Take responsibility of protecting themselves and their fellow workers and visitors.<\/li>\r\n \t<li>Provide adequate resources to meet WHS goals & targets. \u00a7 Undertake WHS training and support approved by work cover. \u00a7 Use safe work methods and practice; identify, assess, monitor and control hazards.<\/li>\r\n \t<li>Report and recording of incidents, accidents, injuries & illness.<\/li>\r\n \t<li>Implement and regularly review and update this WHS policy as required.<\/li>\r\n<\/ul>\r\n<strong>Contractors, apprentices, and subcontractors<\/strong> engaged to perform work on behalf of PEER Construction are to comply with WHS policies, procedures and programs and observe directions on health and safety from designated staff. Failure to comply or observe a direction will be considered a breach of the contract and sufficient grounds for termination of the contract.\r\n<h2>Environment, health and safety programs<\/h2>\r\nOur Environment, Health and Safety Programs are designed to provide a safe workplace, prevent incidents, minimise environmental impacts and pollution and assure compliance with applicable regulations.\r\n\r\nWe strive to identify and eliminate negative environmental impacts associated with our activities, services and through the products we supply. This is accomplished through customer service, utilising innovative solutions and best practices, continuous improvement, and commitment.\r\n\r\nTo fulfil this commitment PEER Construction shall maintain a continuing effort to\r\n<ul>\r\n \t<li>Provide workplace policies, standards, procedures, and training to ensure that employees can perform their jobs in a safe, healthy, and environmentally responsible manner<\/li>\r\n \t<li>Conduct WHS assessments of activities on the site and taking the necessary actions to control identified risks and hazards<\/li>\r\n \t<li>Provide customers, contractors, and general public with information to ensure that our services and materials provided are recycled or dispose of in a safe and environmentally sound manner<\/li>\r\n \t<li>Promote pollution prevention, including the conservation of energy, water, and raw materials resources, and ensure that all waste is handled and disposed of responsibly through work standards and\/or installation of innovative solutions e.g.: water saving devices<\/li>\r\n \t<li>Advise customers and regulating bodies of reported spillage, seepage, or disposal of pollutant substances<\/li>\r\n \t<li>Provide management leadership and require employees to share accountability for continuous improvement in health, safety, and environmental performance<\/li>\r\n \t<li>Review our policies, objectives and targets and addressing all issues promptly<\/li>\r\n \t<li>Comply with all relevant laws, regulations and company procedures related to safety, employee health, environmental quality, and public health as a minimum standard of acceptable practice.<\/li>\r\n<\/ul>\r\n<h2>Roles and responsibilities<\/h2>\r\nPEER Construction shall provide the following key personnel on site. Their roles, and responsibilities regarding safety on site are outlined below.\r\n\r\n<strong>Site Supervisor<\/strong> is responsible for safety on the project and duties include:\r\n<ul>\r\n \t<li>Implementing the company Work Health Safety procedures<\/li>\r\n \t<li>Carrying out a design review with the Principal Contractor\u2019s project team to assist in the Identification of further risk reduction controls measures<\/li>\r\n \t<li>Participating in the planning and design stages of trade activities<\/li>\r\n \t<li>Ensuring safe equipment and plant is provided and maintained; - Reviewing safety reports and inspections and initiating rectification where necessary<\/li>\r\n \t<li>Monitoring compliance with safe work methods (controls)<\/li>\r\n \t<li>Observing all WHS requirements and Statutory rules and regulations<\/li>\r\n \t<li>Ensuring that all works are conducted in a manner safe and without risk to employee\u2019s health and safety<\/li>\r\n \t<li>Provide advice and assistance on WHS to all employees<\/li>\r\n \t<li>Ensuring current WHS and other relevant legislative requirements are met in the workplace<\/li>\r\n \t<li>Identifying WHS training programs in advance and allow for employees identified as requiring training to attend the training<\/li>\r\n \t<li>Actioning safety reports and carrying out workplace inspections<\/li>\r\n \t<li>Preparing and participating in safety meetings and safety programs<\/li>\r\n \t<li>Facilitating the preparation of Work Method Statements and Job Safety Analysis for the trade<\/li>\r\n \t<li>Insisting and ensuring on safe work practices at all times<\/li>\r\n \t<li>Investigating hazard reports and ensuring that corrective actions are undertaken<\/li>\r\n \t<li>Conducting project inductions, toolbox talks and daily team briefings<\/li>\r\n \t<li>Stimulating a high level of safety awareness at all times<\/li>\r\n<\/ul>\r\n<strong>Employees<\/strong> are responsible for safety on the project and duties include:\r\n<ul>\r\n \t<li>Implementing PEER Work Health and Safety procedures<\/li>\r\n \t<li>Identification of further risk reduction controls measures<\/li>\r\n \t<li>Ensuring safe equipment and plant is provided and maintained<\/li>\r\n \t<li>Monitoring compliance with safe work methods (controls)<\/li>\r\n \t<li>Observing all WHS requirements and Statutory rules and regulations<\/li>\r\n \t<li>Ensuring that all works are conducted in a manner safe and without risk to employee\u2019s health and safety<\/li>\r\n \t<li>Participating in safety meetings and safety programs (tool box talks)<\/li>\r\n \t<li>Facilitating the preparation of Safe Work Method Statements and Job Safety Analysis<\/li>\r\n \t<li>All hazards, Injuries or Near Misses should be reported to management at PEER Construction immediately and A Hazard\/Incident or Near Miss Report must be completed.<\/li>\r\n<\/ul>\r\n<strong>Office Manager<\/strong>\r\n\r\nResponsible for maintaining records of safety on the project and duties include\r\n<ul>\r\n \t<li>Maintaining the company Work Health Safety and Rehabilitation documents<\/li>\r\n \t<li>Reviewing safety reports and inspections documentation and initiating rectification where necessary<\/li>\r\n \t<li>Monitoring compliance with safe work methods (controls)<\/li>\r\n \t<li>Observing all WHS requirements and Statutory rules and regulations<\/li>\r\n \t<li>Document control<\/li>\r\n \t<li>Revision and review<\/li>\r\n<\/ul>\r\nPEER Construction is responsible for:\r\n<ul>\r\n \t<li>Maintaining an up to date version of this Policy.<\/li>\r\n \t<li>A record of revisions that occur will be kept in the Record of Revision table below. All obsolete pages will be destroyed<\/li>\r\n \t<li>Providing an updated copy to the Principal Contractor whenever changes occur<\/li>\r\n \t<li>Maintaining a register of people to whom the Policy is issued<\/li>\r\n \t<li>Issuing a completed Policy to all those registered<\/li>\r\n \t<li>Ensuring revisions are distributed to all registered people<\/li>\r\n \t<li>Reviewing the Policy at intervals of not more than one month to ensure it is up to date.<\/li>\r\n<\/ul>\r\n<h2>Procedures<\/h2>\r\nWork Health and Safety Legislation requires anyone in control of the workplace to identify the potential hazards of the proposed work, assess the risks involved and develop controls to eliminate, or minimise, the risk.\r\n\r\nRefer to the Safe Work Method Statement (SWMS) and Job Safety Analysis (JSA) procedures for information about how risk is managed.\r\n<h2>WHS self-checklist<\/h2>\r\nAs part of evaluating how we are working within the WHS guidelines, a self-assessment checklist should be completed by staff.
